New Regulations Enforce Compensation for Airline Delays in Canada

Compensation for Eligible Delays

As of August 2022, Canadian airlines are legally obligated to provide compensation for eligible delays. These regulations aim to protect passengers from the inconvenience and financial burden caused by lengthy flight delays.

Compensation Calculation

The amount of compensation you are entitled to depends on the length of the delay and the distance of your flight. For delays of three hours or more on domestic flights, you may receive up to $1,200.

For delayed international flights, the compensation can be higher, up to a maximum of $2,400 for delays of nine hours or more. The exact amount is calculated based on a predetermined formula.

Eligible Delays and Cancellations

Compensation is only available for delays or cancellations that are within the airline's control. This includes mechanical issues, staffing shortages, and weather events beyond the airline's reasonable control. However, compensation is not provided for delays caused by factors such as security checks or passenger behavior.

In cases where the airline denies your compensation claim, you have the right to file a complaint with the Canadian Transportation Agency (CTA).

Additional Protections

Besides compensation for delays, Canadian airlines are also required to provide additional standard of treatment to passengers affected by long delays. This includes:

  • Access to food and drinks
  • Accommodation if the delay requires an overnight stay
  • Ground transportation to and from the airport if the delay exceeds eight hours

These regulations ensure that passengers are treated fairly and receive compensation for the inconvenience caused by airline delays.
